No business can survive without sufficient funds, as every action done in its operations generally have corresponding costs attached to it. When it comes to finances, however, one of the most common challenges faced by many businesses is the difficulty of collecting from their debtors the amounts owed to them. So, how is debt collection being carried out?
Pressuring debtors to obtain payment
Pressure may be employed, but only through legitimate means, such as filing of legal action, or availment of other legal remedies to collect the amount due. Resort to harassment in collecting from the debtor should be avoided, as this may enable the debtor to turn the table against the creditor who, because of his bullying, would just expose himself to civil liability for damages, and even criminal liability for coercion.
Some examples of such bullying would be by calling debtors during very inconvenient hours (e.g. between 10:00 PM and 6:00 AM); employment of threats; misrepresenting oneself as lawyers, police officers, or other government authorities to intimidate the debtor; making false statements about an impending punishment in connection with a pending case where no case is actually pending; contacting the debtor’s friends, family, neighbors, and workmates, and discussing with them the details of the debtor’s indebtedness; and threatening to deposit post-dated checks prematurely.
Legal remedies in collecting unpaid debt
Creditors who are having problems collecting from their debtors may very well resort to the following legal remedies:
- To file an action for collection of sum of money before the court.
- In case the debt is secured by a mortgage, the creditor may choose either to file an ordinary action for collection, or he may have the mortgage foreclosed.
- In case there is a check issued, which bounced, the offended party may file a complaint for violation of the Anti-Bouncing Checks Law. This is a criminal action, and therefore imprisonment is among the possible consequences upon conviction.
Civil action for collection of sum of money
If the creditor opts to file an action for collection of sum of money, all that the creditor needs to establish are the existence of a transaction for which the debtor became indebted (which may be a loan, or any dealings that create obligations such as sale concerning unpaid purchase price, or lease concerning rentals), the amount of money owed by the debtor, the fact that the obligation is already due and demandable, and that a demand had been made by the creditor upon the debtor.
Please take note, though, that if the debt does not exceed P200,000.00 (excluding damages and interests), the creditor may file his claim before the Small Claims Court. Since the amount of the claim is relatively small and the relief prayed for is solely for payment or reimbursement of sum of money, it is the court’s policy in small claims proceedings not to keep these cases from dragging for long periods before finally being decided. Since the proceedings must be speedy, inexpensive, and informal, the Small Claims Procedure was made much more simple.
Foreclosure of mortgage
Foreclosure is a necessary consequence of non-payment of mortgage indebtedness. In a real estate mortgage, when the principal obligation is not paid when due, the mortgagee-creditor has the right to foreclose the mortgage and to have the property seized and sold for purposes of applying the proceeds to the payment of the obligation [See: G.R. No. 178367].
Foreclosure of mortgage may be done through a complaint filed in court (judicial foreclosure). But the creditor, if authorized by the debtor in writing, may foreclose the mortgage constituted on the property without going to court (extrajudicial foreclosure). By virtue of his granted authority, the creditor may take possession of the mortgaged property, and sell it in a public auction, subject to the requirement that notice of the sale has to be given by posting the same for not less than 20 days in at least three public places in the city or municipality where the property is situated [See: Sec. 2, Act No. 3135]. If no such authority to sell was granted to the creditor, then he has no other alternative but to resort to judicial foreclosure.
If the proceeds of the sale are insufficient to cover the entire amount of the debt in an extrajudicial foreclosure of mortgage, the creditor is entitled to claim the deficiency from the debtor [See: G.R. No. 175816].
Criminal action for violation of Anti-Bouncing Checks Law
The Anti-Bouncing Checks Law (B.P. Blg. 22) was passed for the specific purpose of addressing the problem of continued issuance and circulation of unfunded checks. B.P. Blg. 22 considers the mere act of issuing an unfunded check as a criminal offense [See: G.R. No. 191404].
Violation of B.P. Blg. 22 shall be punished by imprisonment for 30 days to 1 year, or by a fine of double the amount of the check, but in no case it shall exceed P200,000.00. Both such fine and imprisonment may, however, be imposed at the discretion of the court.
With such remedies that every creditor may avail of against the defaulting debtor, all such creditor has to do is to choose what he believes is most effective and convenient based on the circumstances surrounding his credit. Always bear in mind that unless creditors take action, many debtors will simply ignore their obligations. Precious cash need not be unnecessarily sacrificed, especially by business entities, simply because of difficulty in collecting debts. This holds very true when the money to be collected could be used on other business activities that would bring more money in the pocket.

Yung creditor mo lang ang makakasagot kung willing syang babaan ang utang mo sa kanya. Saka try mo din manghingi ng breakdown or statement of account para makita mo kung magkano ba talaga ang exact amount ng interest and penalties na nag-accrue sa principal obligation mo.
Kahit sabihin nating interest and penalties lang ang pinapa-waive mo, may karapatan parin ang bank na tumanggi sa request mong bigyan ka ng discount, dahil allowed ng batas ang pagkolekta ng interest sa utang, lalo na kung pinayagan mo ito based sa mga kontratang pinirmahan mo noong kumuha ka ng credit card.

Hindi ka makukulong dahil lang sa hindi ka makabayad ng utang. Kung kasuhan ka man, small claims case lang ang pwedeng i-file against you (pag less than P200,000.00 ang utang, under ito ng small claims procedure).

Hindi ka makukulong, dahil walang nakukulong dahil lang sa hindi makapagbayad ng utang. Pero, since nasa korte na ang loan mo at doon kayo nagkaroon ng arrangements to pay P2,000 every month for five years, I would suppose meron kang pinirmahang Compromise Agreement.
Pero, dahil sa hindi mo natupad ang napagkasunduan sa korte, pwedeng humiling ang creditor mo na ipa-execute sa court yung obligasyon mo na nasa Compromise Agreement. Mag-iisue ang court ng order na inuutusan kang magbayad, at kung hindi ka makakapag-bigay, maaaring ipahatak ng korte ang mga pag-aari mo upang isubasta, at ipambayad ang proceeds ng sale sa creditor mo.
Habang hindi pa nagpapa-execute ang creditor mo, mas maigi kung ituloy mo lang ang pagbabayad mo kahit magkano lang ang kaya mo. Ito lang talaga ang magagawa mo sa ngayon, basta siguraduhin mo lang na tuloy-tuloy lang ang pagbabayad mo. Hindi ito garantiyang hindi lalapit sa korte ang creditor mo para ipa-execute ang obligasyon mo base sa inyong kasunduan, pero kung nakikita nya na in good faith ka naman sa pagbabayad, baka lang makakuha ka ng simpatya mula sa kanya (uulitin ko, hindi ito garantiya).

Kung may “HIT” ka sa NBI, baka naman may kapangalan ka lang na may pending criminal case, so it’s possible na hindi ikaw yun. Bumalik ka lang sa petsa kung kelan ka pinababalik ng NBI para kuhanin ang clearance mo. Kung talagang kapangalan mo lang ang may pending case, then you may claim your clearance. Kung medyo nahihirapan ang NBI sa pag-verify ng identity mo, pwede ka nilang irequire na pumunta sa Main Office nila sa Manila para sa interview. Kung ma-verify na hindi ikaw yung may case, pwede mo na din ma-claim ang clearance mo.
Pero kung sakaling ikaw nga yung may pending criminal case (most likely, for violation of B.P. Blg. 22, based on your narration), then you will not be able to claim your NBI clearance.
In BP 22 cases, madalas nag-iisue ng warrant of arrest kung hindi lang naka-attend ng arraignment ang akusado sa schedule na itinakda ng korte, so posibleng wala pang warrant na na-issue against you. But just in case lang na meron nang warrant, puntahan mo yung court kung saan pending ang kaso mo, at mag-post ka ng bail.
As to your business partner, pwede mo sya idemanda for damages. Regarding sa hiniram nyang pera sa mother mo, pwede sya idemanda ng small claims.

Pwede kang kasuhan ng civil case kung dito ka nila sa Pilipinas kakasuhan. Pero hindi ka makukulong, dahil hindi ka makakasuhan ng criminal case sa loan na hindi nabayaran.
Pero, ikaw na mismo ang may sabi, “mahabang kwento”. So kung meron ka man ibang nagawa at worried kang mademanda ng criminal case, pwede lang isampa ang demanda sa lugar kung saan ito nangyari. As far as criminal case is concerned, kung hindi dito sa Pilipinas nangyari, hindi ka din dito sa Pilipinas maidedemanda.

Pinuntahan po ako ng staff ng coop twice pero sabi ko po, naka-hold ang sahod ko kasi mag a-abroad ako. Sumulat po ako sa kanila last Nov 2017 na kung pwedeng yung principal na lang bayaran ko. Pero di pumayag yung manager. Sinisingil pa rin ako ng almost 150k. E ang naibayad ko pa lang po is 50k. Kakasuhan na lang daw nila ako. Ano po ang dapat kong gawin? Try mo manghingi ng breakdown ng pagkakautang mo, para makita mo kung paano yun lumaki ulit sa P150,000 (posibleng kasama na yung amount ng pinaka-recent na inutang mo). Kung hindi mo mabayaran lahat, try mo na lang makipag-renegotiate kung mapagbibigyan ka nila ng hulugan. Mag-propose ka ng terms of payment mo na sa tingin mong kaya mo (magkano ang proposed periodic payment, ilang installments, at hanggang kailan), dahil hindi naman kailangan bayaran agad lahat kung hindi talaga kaya. Kung hindi parin pumayag ang creditor mo, wala na tayong magagawa dahil hindi natin sya pwedeng pilitin mag-agree.
Kung umabot man sa puntong kasuhan ka, small claims case lang ang pwedeng ikaso sayo. Siguraduhin mo na lang na intact lahat ng proof of payments mo (sa mga previous na pagbabayad mo) para may panghawakan ka sa depensa mo. Kahit paano makakabawas yun sa amount na masisingil sayo.
Regarding sa pagkakautang ng officemate mo, kahit co-maker ka, dapat sya muna ang habulin ng creditor bago ikaw. Alalahanin mo muna ang utang mo bago yung sa kanya.

I borrowed money from Moola lending. It was 5000.00. I was not able to settle the full amount since my daughter was confined that time in the Hospital. I tried to explain to them the reason of the delay since they’ve been calling me 15 times a day even at night time just to push me to pay the full amount. I responded them to email but they never respond. Now they are asking me to pay 7700.00 Pesos plus the 1500.00 for prolongation. So it is now total of 9200.00 and I just loan it last month January 15 2018. I was just thinking that it is too much from what I supposed to pay. I wont pay that amount just because I cant pay it on time. What legal action you guys can advised ? please help me.

If you feel harassed by being called too many times in a day even during very inconvenient hours, you can report them to the Financial Protection Consumer Department of the Banko Sentral ng Pilipinas.
Pay your debt once you can, but just pay what is equitable, that is, your actual loan plus the legal interest rate of 12% per annum. Keep all proof of payment so that you will have something to show in case a legal action is filed against you (though I doubt that they will file a case because the amount of your loan is very negligible that they would not even bother to spend time and resources just to bring you to court).

Kung wala ka naman talagang maipambayad pa, hindi ka talaga makakabayad “tomorrow”. Though you have to understand that they have to give you deadlines, because otherwise hindi sila makakapag-create ng enough pressure for you to pay. Regarding the interest rate, hindi naman malinaw sa query mo kung ilang percent ba ang napag-usapan nyo. Ganun pa man, kung sa palagay mo ay sobrang laki ng interest ng loan mo, you may ask the court to reduce the rate if dumating man sa point na idemanda ka (which I doubt, considering that they are asking you to pay only P10,000). Hindi din malinaw kung anu-ano ang mga legal actions na binaggit sayo ng creditor mo, pero ang pwede lang nilang isampa sayo is small claims case (less than P200,000 lang kasi ang utang mo, at wala ka naman din check na ni-issue).

Based from your narration, hindi ito estafa dahil wala ka naman check na inissue para pautangin ka. Wala ka din warrant of arrest dahil hindi makakpagsampa ng criminal case laban sayo dahil lang sa hindi ka nakapagbayad ng utang mo. Pwede rin nila habulin yung co-maker mo, pero kailangan muna nila singilin sayo ang utang at kung talagang wala ka nang maibayad, saka lang sila pwedeng maghabol sa co-maker mo.

Hi atty. Im actually havibg issues with moola. Im trying to cntact them through mail but they are not reapky. My 4000loan was already overdue and they only gave me 3600 due to processibg fee and may interest appeared as soon as they approved the loan yet i was not yet able to recieve the money now they keep on saying i need to pay the amount of 9960 pesos. As long as they are calling you within reasonable hours, masasabi nating ginagawa lang nila ang trabaho nilang maningil sa mga debtors nila. Kung talagang pakiramdam mo ay nabubulabog ka na sa madalas nilang pagtawag sayo, madaliin mo na din yung pagprocess ng backpay mo para magka-peace of mind ka na din after mo mabayaran ang obligasyon mo.

Hindi yan makakaapekto sa pag-apply mo ng NBI clearance, kasi wala ka naman criminal case. Yung sa VISA application mo naman, nakadepende na sa bansang pupuntahan mo kung ano ang mga requirements nila kung pagbibigyan ka nila magka-VISA o hindi.

Atty, pano po kaya dapat gawin? Marami na po kasing reklamo against sa moola/dr. Cash kasi ang laki po kasi ng tubo nila. Last oct. Nakpag renew po ako sa kanila ng 5,000. Bayaran mo parin yung creditor mo kung magkano ang amount ng principal, plus interest sa legal rate na 12% per annum. You do the computation, tapos yun ang total na bayaran mo. Make sure intact lahat ng proof of payment mo. Just in case lang na magdemanda si creditor after mo mabayaran lahat, gamitin mo yung proof of payment mo para depensahan ang sarili mo. Since meron ka na din interest na binayaran at the legal rate, hilingin mo sa court na ireduce yung interest for being unconcionable. Although discretion na yun ng court kung pagbibigyan ka, kasi meron naman talaga kayong kasunduan pagdating sa interest na kailangan mo bayaran. Pero dahil allowed ng batas ang court magbaba ng interest rate kung talagang sobra-sobra sa laki ang interest na napagkasunduan, it’s worth a try on your part.
Kung hindi ka parin nila tigilan after mong mabayaran kung ano ang due mula sayo, wag mo na lang sila pansinin para hindi ka na ma-stress. Kung magdemanda man sila (at pwede rin namang hindi ka na nila pagkaabalahan idemanda pa), ayos lang kasi nakabayad ka na, basta ilabas mo na lang lahat ng mga proof of payment mo.
