Proven ways in debt collection

No business can survive without sufficient funds, as every action done in its operations generally have corresponding costs attached to it. When it comes to finances, however, one of the most common challenges faced by many businesses is the difficulty of collecting from their debtors the amounts owed to them. So, how is debt collection being carried out?

Pressuring debtors to obtain payment

Pressure may be employed, but only through legitimate means, such as filing of legal action, or availment of other legal remedies to collect the amount due. Resort to harassment in collecting from the debtor should be avoided, as this may enable the debtor to turn the table against the creditor who, because of his bullying, would just expose himself to civil liability for damages, and even criminal liability for coercion.

Some examples of such bullying would be by calling debtors during very inconvenient hours (e.g. between 10:00 PM and 6:00 AM); employment of threats; misrepresenting oneself as lawyers, police officers, or other government authorities to intimidate the debtor; making false statements about an impending punishment in connection with a pending case where no case is actually pending; contacting the debtor’s friends, family, neighbors, and workmates, and discussing with them the details of the debtor’s indebtedness; and threatening to deposit post-dated checks prematurely.

Legal remedies in collecting unpaid debt

Creditors who are having problems collecting from their debtors may very well resort to the following legal remedies:

  1. To file an action for collection of sum of money before the court.
  2. In case the debt is secured by a mortgage, the creditor may choose either to file an ordinary action for collection, or he may have the mortgage foreclosed.
  3. In case there is a check issued, which bounced, the offended party may file a complaint for violation of the Anti-Bouncing Checks Law. This is a criminal action, and therefore imprisonment is among the possible consequences upon conviction.

Civil action for collection of sum of money

If the creditor opts to file an action for collection of sum of money, all that the creditor needs to establish are the existence of a transaction for which the debtor became indebted (which may be a loan, or any dealings that create obligations such as sale concerning unpaid purchase price, or lease concerning rentals), the amount of money owed by the debtor, the fact that the obligation is already due and demandable, and that a demand had been made by the creditor upon the debtor.

Please take note, though, that if the debt does not exceed P200,000.00 (excluding damages and interests), the creditor may file his claim before the Small Claims Court. Since the amount of the claim is relatively small and the relief prayed for is solely for payment or reimbursement of sum of money, it is the court’s policy in small claims proceedings not to keep these cases from dragging for long periods before finally being decided. Since the proceedings must be speedy, inexpensive, and informal, the Small Claims Procedure was made much more simple.

Foreclosure of mortgage

Foreclosure is a necessary consequence of non-payment of mortgage indebtedness. In a real estate mortgage, when the principal obligation is not paid when due, the mortgagee-creditor has the right to foreclose the mortgage and to have the property seized and sold for purposes of applying the proceeds to the payment of the obligation [See: G.R. No. 178367].

Foreclosure of mortgage may be done through a complaint filed in court (judicial foreclosure). But the creditor, if authorized by the debtor in writing, may foreclose the mortgage constituted on the property without going to court (extrajudicial foreclosure). By virtue of his granted authority, the creditor may take possession of the mortgaged property, and sell it in a public auction, subject to the requirement that notice of the sale has to be given by posting the same for not less than 20 days in at least three public places in the city or municipality where the property is situated [See: Sec. 2, Act No. 3135]. If no such authority to sell was granted to the creditor, then he has no other alternative but to resort to judicial foreclosure.

If the proceeds of the sale are insufficient to cover the entire amount of the debt in an extrajudicial foreclosure of mortgage, the creditor is entitled to claim the deficiency from the debtor [See: G.R. No. 175816].

Criminal action for violation of Anti-Bouncing Checks Law

The Anti-Bouncing Checks Law (B.P. Blg. 22) was passed for the specific purpose of addressing the problem of continued issuance and circulation of unfunded checks. B.P. Blg. 22 considers the mere act of issuing an unfunded check as a criminal offense [See: G.R. No. 191404].

Violation of B.P. Blg. 22 shall be punished by imprisonment for 30 days to 1 year, or by a fine of double the amount of the check, but in no case it shall exceed P200,000.00. Both such fine and imprisonment may, however, be imposed at the discretion of the court.

With such remedies that every creditor may avail of against the defaulting debtor, all such creditor has to do is to choose what he believes is most effective and convenient based on the circumstances surrounding his credit. Always bear in mind that unless creditors take action, many debtors will simply ignore their obligations. Precious cash need not be unnecessarily sacrificed, especially by business entities, simply because of difficulty in collecting debts. This holds very true when the money to be collected could be used on other business activities that would bring more money in the pocket.

    My husband and I have a loan with Global Dominion and we’re behind 1mon. sa payment. Yung collection agency nila na First Maharlika ay grabe mang harass sa amen and they’re also contacting those Character References na binigay namen during loan application and they’re disclosing the details of our loan sa kanila. Ganito po ang message nila sa mga Character References namen:

    Goodday Thiz is From First maharlika collection department ng Global dominion,Mr.and Mrs. XXX,inform kolang sa inyo na wala pang payment ang for month of nov.20 due date ninyo may demand letter na kayo dito pakisettle naho 18,506.00 magdalawang buwan na kayo this dec.20.

    Legal po ba ang pagdisclose nila ng details ng loan namen sa mga Character References? Hindi naman po Sila Guarantors.

    I already made payment for our November due, sa ngayon 1mon Lang po kami behind.

    I hope to hear from you po Atty kase gusto kong balikan ang Collections Agency nila dahil feeling ko we are violated dahil sa pag disclose nila ng details ng loan namen.

      I-report mo yung collection agency sa Financial Protection Consumer Department of the Banko Sentral ng Pilipinas. Maigi kung na-preserve mo lahat ng pang-harass na communications na pinadala ng collection agency sa mga character references mo, such as letters, text messages and emails.

        Gusto ko lang po ma enlightened tungkol sa problema ng husband ko contractor po siya & may utang po siya sa isang supplier namin ng construction materials. Nakapag isyu po siya ng check on date knowing may pundo pa kami sa bank kaso na mislook niya na may mag due rin na check that day.. kaya nung pinasok na nung supplier iyong insisyu na check nag insufficient funds na. Since insufficient na iyong funds namin tumawag iyong manager pumunta iyong husband ko sa office nila & nag partial ng 50k kasi iyon na lang iyong kaya namin ebayad kasi naghinhintay din kami na maka bill sa on going projects niya..pumayag naman iyong manager.. since government projects po mostly ang project niya mostly delayed iyong processing ng payment kaya nakapagbigay kami ulit ng 25k ok din naman sa management.. lately di pa po naka pag bigay iyong husband ko kasi hirap pa kaming maka bill dun sa projects & may mga tao pa kaming kailangan swelduhan.. may balance pa kaming 203k sa kanila.. this morning nag text iyong sales agent nila na for litigation na raw iyong husband ko for bp22 constituent with estafa.. I’m worried po kasi baka mag isyu ng warrant of arrest at makulong siya.. pero kaya naman po namin siyang bayaran pag naka bill na po kami sa on-going projects namin or unti unti pag may pera kami.. pag nag file po ba sila ng case sa court makukulong po agad ang husband ko? Ano po dapat naming gawin? Maraming salamat po..mag hihintay po ako sa advice niyo atty. Wala pa naman po kaming natatangap na letter from court or demand letter from the company text lang po galing sa sales agent nila..

        • Dear Lei Migz,

          Receipt of a demand (with notice notice of dishonor) is necessry before your husband may be prosecuted for violation of BP Blg. 22 and estafa through bouncing checks. Kung wala kyong demand and notice of dishonor na nareceive, pwede nyo yun gamitin as defense kung ituloy man ng creditor na mag-file ng criminal complaint against your husband.

          So, kung mag-file man sila ng criminal complaint, dadaan pa muna yan sa Prosecutor’s Office for Preliminary Investigation before umabot sa court, at ang court lang ang may kapangyarihan mag-issue ng warrant of arrest.

          Assuming na mag-file sila ng criminal complaint against your husband, subukan nyo nang makipag-ayos sa creditor habang nasa level pa lang ng prosecutor ang case. Although, always keep in mind that you can still use as your defense the fact that you did not receive a demand before the complaint was filed.

      Nakadepende sa creditor kung kailan sya maniningil o kaya ay magdedemanda sa korte for collection of sum of money (through filing of a complaint), as long as yung demanda nya ay hindi lalagpas ng 10 years mula sa pag-default ng debtor sa kanyang obligasyon magbayad. Pero kung verbal lang ang kasunduan ng debtor at creditor (walang pinirmahang written agreement), within 6 years lang dapat makapagdemanda na yung creditor sa korte.

  • Nagtayo po kami ng kaibigan ko ng business. 2 pwesto yung isa nakapangalan sa kanya yung isa nakapangalan sa akin. yung nakapangalan sa akin may share akong cash. yung nakapangalan sa kanya wala ako share na cash pero ako nagbabantay. nagkaproblema kami nagkaroon ng pag aaway. pinaalis nya ako dun sa nakapangalan sa kanya at gusto nya kunin yung share nya dito sa nakapangalan sa akin. hindi ako pumayag kasi wala na ako ibang source of income kasi pinaalis nya ako dun sa shop nya. sabi ko babayaran ko na lang share nya pero huhulugan ko na lang. ayaw nya at ang gusto nya ay hakutin ang mga gamit sa shop ko. lahat ay verbal ang usapan wala kami pinirmahan na kasunduan na share kami sa business na nakapangalan sa akin. ano po kaya ang pwede nya gawin kasi maghintay lang daw ako at mag dedemanda sya. maaari nya po bang kunin mga gamit dito sa shop kahit sabihin ko na babayaran ko na lang pero huhulugan ko lang.

      Valid yung mga verbal agreements nyo, pero dahil hindi ito nakadokumento, mahirap itong patunayan.

      Dahil sa nakapangalan sayo yung business, ikaw ang maituturing na may ari ng negosyo (assuming na nagrehistro ka bilang isang single proprietorship sa DTI), pati na ang mga pag-aari at mga kagamitan nito. Kung ikaw ay idedemanda nya, pwede mo syang hayaan mamroblema kung paano nya patutunayan na ang business ay isang partnership, at hindi single proprietorship, bago sya magkaroon ng karapatan sa mga ari-arian nito.

      Assuming na mapatunayan nyang partnership nga ang negosyo, hindi parin nya basta-basta pwedeng kuhanin ang mga gamit sa shop. Kailangan munang ipa-account kung anu-ano ba ang mga nasabing pag-aari ng negosyo, at kung gaano karami ang share nya dito. Sa kadahilanang partnership ang business, ang mga nasabing mga gamit ay pag-aari ng partnership, kaya dapat munang i-liquidate ang mga partnership assets bago i-distribute ang mga ito sa inyong mga partners.

          Happy new year to you too. Yes, pwede nya gamitin yung FB conversations ninyo as evidence. In fact, kahit anong electronic conversations ninyo such as social media, emails and text messages ay maaaring nya magamit bilang ebidensya (except voice conversations tulad ng pakikipag-usap sa phone, dahil kung irerecord nya ito nang wala kang pahintulot ay violation ng Anti-Wiretapping Law).

            Nireklamo na po ako ng kaibigan ko sa bgy. Nag alok na po ako ng 50 thousand bilang paunang bayad sa declared niyang share nya sa business na 325 thousand. pero hindi po siya pumayag. ang gusto nya 200 thousand o kaya hahakutin nya kalahati ng bilang ng mga computer sa shop. dahil po hindi nman ako pumayag na kumuha siya ng computer, maghaharap po uli kami sa bgy. sa January 22. ang gusto nya po kasi makakuha ng cfa para para po madala nya sa court, kaya nagtatakda siya ng halaga na di ko kaya. kung sakali po na mapunta sa korte ito maaari na po kaya siya kumuha ng computer sa shop kahit nagsalaysay na siya sa Bgy na pumapayag na siya bayaran na lng share nya basta 200k po ibibigay ko. pero wala po talaga ako 200k. 40k lang po kinikita ng shop sa isang buwan 10k ang upa sa pwesto. 7k ang meralco bill at 3k ang internet. wala lang po talaga kami ibang hanapbuhay kaya di ko mabitawan to.

            • Dear Janette Tan,

              Kahit makarating sa korte ang usaping ito, hindi nangangahulugang makakakuha na sya ng computer mula sa shop. Kailangan pa nya munang patunayan na entitled nga sya sa bahagi ng negosyo mo bago mag-utos ang korte na sya ay mapagbigyan. Tulad ng nabanggit ko na sayo dati, kailangan muna nyang ma-establish na ang negosyo ay isang partnership, at ipa-account kung ano ba ang mga gamit sa shop na talagang pag-aari ng partnership bago ito i-distribute sa pagitan ninyong dalawa.

              Sa ngayon, since nasa barangay pa lang ang usapin, wala namang mawawala kung magkakasundo kayo. Mas mainam ito para makabuo kayo pareho ng “win-win” arrangement para sa inyong dalawa. Pero kung talagang magmamatigas sya at walang balak makipag-ayos, wala na tayong magagawa doon. Pero, ganun pa man, kailangan parin nya patunayan ang entitlement nya sa mga assets ng shop bago nya ito maaaring makuha.

      Huwag kang matakot, dahil tinatakot ka lang ng nagtext sayo. Walang sheriff na pupunta sa bahay mo para dakipin ka. Ang sheriff ay empleyado ng korte, at kung wala namang nakasampang kaso laban sayo sa korte, wala kang sheriff na kailangan alalahanin. Assuming na ikaw ay nakademanda, wala din parusang kulong sa hindi pagkakabayad ng utang, kaya hindi ka din maipadadakip. Tinatakot ka lang.

          May preliminary investigation lang kung may criminal case na naka-file sa prosecutor’s office. Posible lang ito kung may cheke kang ni-issue (violation of BP 22) or may panggagantso na nangyari (estafa). Otherwise, civil case lang for collection of sum of money (or small claims kung hindi lalagpas ng P200,000.00 ang utang) ang maaaring i-file laban sayo, at walang kulong yun.

          Pwede ka din ireklamo sa barangay, pero wala din yun kulong. Ang gagawin lang ng barangay ay susubukan kayong pag-ayusin ng creditor mo.

  • good day atty.
    i have a pending hospital bill, amounting to nearly 450,000 we already paid somewhere around 160,000but the balance is still quarter a million and we are indigent since both my parents are unemployed, i am employed but due to my expensive medication & chemo i am not able to raise any amount for the bill.
    last march 2017, i am about to be discharged, but they wouldnt allow us unless we pay the entire amount, so we stayed ay the hospital (private room) until may 2017
    soo wee seek help from the local radio station, we are able to talk to a lawyear and he advised us to go to the police station do a blotter and just leave the hospital after, so technically (tumakas kami sa hospital)
    we did what was advised. last week we received a call fron the philhealth dept of the hospital that there is a paper that we need to sign so at least this certain amount will be deducted from the entire bill.
    after arriving at the hospital, i was intead brought inside the billing dept and to be honest i felt harassed the person fron the billing dept. humiliated me by nagging about my case in front of othe employees. she made me sign a promisory note to pay the balance before january 20 2018, i said we cannot raise that amount on the given date. but she told me if i dont sign the paper they will file a case and it will cost us and them, and charges will add up to our hospital bill, i got scared so i signed the paper,

    will i be imprisoned or my mother for our hospital balance? it was my mom who processed all the paperworks while i was in the hospital.

    and if a case will be filed, will i be labeled as “with hit” if i get an NBI?

    Im soo scared right now. please help

    • Dear chasingshadow,

      It is not right for any creditor to resort to harassment in trying to collect the amounts due from the debtor. Be that as it may, however, it is the hospital’s right to make you sign a promissory note. It is so because under the law (R.A. No. 9439), patients who have already recovered, whether fully or partially, who wish to leave the hospital but financially incapable to settle the bill shall be allowed to leave upon execution of a promissory note covering the unpaid obligation. I am not in any way saying that harassment is justified, but you must realize also that you already had the benefit of leaving the hospital without settling the bill and not executing a promissory note for your outstanding obligation (as required by law).

      If you believe that you are not capable of settling the bill within the timelines that the hospital had set for you, then it is important that you be the one to give your own timeline, and indicate such timeline in your promissory note, so that the hospital would also know what to expect. This notwithstanding, I agree that the person in the billing department should NOT have humiliated you in making you sign that promissory note.

      For your peace of mind, you and your mother will never be imprisoned simply because of unpaid debt, because the Philippine Constitution itself guarantees that no person shall be imprisoned for non-payment of debt. If at all, what can be filed against you is not a criminal case, but only a civil case for collection of sum of money. Since no criminal case is involved, filing a collection case against you is not supposed to affect your NBI clearance application (unless there is someone else with a similar name as yours happens to have a criminal case, then you may have that “hit” when you apply for clearance).

  • Good day.

    I filed for a personal salary loan back in July, and was granted. The amount released for P40,000 and this was a help that was extended to my ex-partner to fund his car loan. He didn’t have sufficient papers to apply for a salary loan, hence my name on the financial institution. We had a verbal agreement that he will pay the loan when I handed the cash over. But due to livelihood plans of his that did not materialize, I ended paying the first two months amortization. When we separated, he simply made a promise that he will pay the monthly amortization. When I asked him to sign a written agreement, with terms copied from the original terms and condition provided by the financial institution who granted the salary loan, he refused to do so. I took the matter to the barangay to seek help for him to simply sign the agreement,but he was insistent that he will not sign such document wherever this may lead to. He simply stated that he is the aggravated party should he sign. My point was simple. If he is so sure that he will pay on time, then why is he going to be aggravated? I have text message to confirm that he indeed know that he is indebted to me, and will pay the monthly amortization. And the session at the Barangay was also documented. Please. I am seeking legal help as to how do i go about this dilemma. Can I bring this to Small Claims court? Without a contract of the loan between him and I? I am a single mother , and I can not afford to pay a hefty amount if he seize to pay the monthly obligation. There will be heavier penalties, and my name is at risk of having negative credit score to financial institutions if he miss making payments. This predicament is taking toll on me and my job, as I work nights. Will the Public Attorney’s Office help? Do I even have a case?

    Would appreciate any reply and/or help I could get.

    • Dear SariGabriel,

      It’s good that the proceedings before the Barangay were documented, so if his admissions of indebtedness are contained in the barangay documents (e.g. minutes of the proceedings), then you may use it as evidence if ever you plan to take up legal action against your ex-partner. Unfortunately for you, if you plan to bring a collection case against him for the amounts due for the monthly amortizations, then you can only sue for the amortizations that already fell due. This means that you still have to wait for all monthly amortizations to fall due before you can file an action for collection based on the ENTIRE amount of the loan that you paid on his behalf (and you have to actually pay for the loan for you to have a cause of action to collect from your ex-partner). Based on your circumstances, your legal remedy is not an action for collection of sum of money, but an action for specific performance if you intend to compel him to sign a written contract with you regarding the internal arrangement between the two of you where he has to assume all responsibilities for the loan that you took for him.

      Makipag-ayos ka sa creditor mo. Kung wala ka pang pambayad sa ngayon, kausapin mo yung creditor mo (or yung collection agency na may hawak ng account mo) at ikaw na ang magbigay ng offer mo sa kanila based on terms and conditions na sa tingin mo kakayanin mo. Kung tanggapin nila yung offer mo, well and good. Wala naman masama makipag-negotiate.

Legal po ba yun? Ano po ba dapat kong gawin if hndi ko kayang bayaran ung hinihinge nilla especially now na buntis aq at uuwi lng para manganak. May kaso na daw po aq Bp22, san at paano ko po ba macheck kung tlgang me kaso at totoo ba na huhulihim aq sa airport pag uwi ko?makakabalik pa ba aq dito sa bahrain incase umuwi ako?     • Dear Chelxymae,

      It’s normal for them to demand from you to pay your obligation, at hindi na problema ng creditor mo kung nanakaw yung dapat impambabayad mo sa kanya. Pero hindi totoo yung sinasabi sayo na ipadadampot yung mga relatives mo, dahil wala naman silang ginawang kasalanan para ipaaresto. In the first place, wala naman criminal case na naka-file sa kanila kaya wala din basehan ang pagpapadampot sa kanila.

      Kung may na-issue kang cheke na tumalbog, pwede ka talagang makasuhan ng violation of B.P. Blg. 22. Kung may isinampa mang kaso laban sayo, most likely doon yan sa Prosecutor’s Office ng city or municipality kung saan nila sinubukang i-deposit or i-encash yung check. Doon ka magverify kung may case na pending laban sayo.

      Assuming na meron kang kaso for violation of B.P. Blg. 22, hindi ka parin nila maipapahuli pag-uwi mo dito sa Pilipinas kung wala ka naman warrant of arrest. Lalong hindi ka nila maipapahuli kung sakali mang wala naman talagang kaso na naka-file laban sayo.

  • Dear mhelay. Hindi mo kailangan mag-alala sa text na natanggap mong nasa Supreme Court na daw yung case mo. Malakas ang kutob kong wala pang case na naifa-file laban sayo. Kung sisingilin ka lang ng utang mo, either sa Regional Trial Court or sa Metropolitan/Municipal Trial Court (depende sa amount) lang sila pwede magsimula magdemanda, at kung tatalon sila straight to the Supreme Court ay madidismiss lang yung kasong isasampa nila.

    Saka hindi through text message ang pag-notify sayo kung totoong may kaso ka. Summons mula sa RTC or MTC lang ang official na dokumentong pang-notify sayo na ikaw ay nakademanda. At itong summons ay dapat dala-dala ng sheriff or ng court process server sa bahay mo o sa lugar pinagtatrabahuhan mo, kaya hindi uubra ang pa-text text lang gaya ng natanggap mo.

My utang po kc AQ a moola lend pero hndi q pa byad 2 months na..nag email nmn ako sa knila and cnasabi ko na hndi ko pa mbabayadan ngayu ung pera kaso hndi nmn cla nagrereply skin,tinatanong ko kung ano ba dpat Kong gawin kaso wala clang respond! Tpos khpon my dumting sakin na text na NSA supreme court ndaw ung case ko and mag voluntary surrender nadaw ako..2k LNG nman ang utang ko sa knila na tinubuan nila ng npkalaki na umaabot ng 80 pesos ang isang araw ! Ano po ba dpat Kong gawin???

    • gud day, kami rin po my loan sa moola lending, 4k po pero 3600 lang po natanggap namen and aftr 1 month kelangan namen sya bayaran ng 5200 but unfurtunately d po kami nakabayad kc d po inaasahang nagkasakit ang anak namen, pero nagpasabi po kami n d pa namen mbabayaran ung loan pero habang tumatagal po kc lalong lumalaki ung interest,pang 3 months n po ngaung dec.13 kaso umabot n po sa 9k at may nag email n 14 k n daw po ang kailangan naming bayaran, my god!! kinikilabutan ako… tapos ngaun lang may nag txt n nasa suprme court n daw at kailangan n daw pong volountary surrender n daw po c husband ko…anu po bang pwedeng gawin sa gnyan sir?..

      • Dear Jude,

        Hindi totoong nasa Supreme Court na ang kaso ng pagkakautang mo. Kung idedemanda ka man nila, dapat sa Municipal Trial Court sila nagsampa ng small claims case at hindi diretso sa Supreme Court. Wala din “surrender” na kailangang alalahanin, dahil wala naman kulong ang hindi pagkakabayad ng utang.
