RULES ON NEGOTIATED SALE UNDER REPUBLIC ACT NO. 10752 OTHERWISE KNOWN AS “THE RIGHT-OF-WAY ACT”

The implementing agency may offer to acquire, through negotiate sale, the right-of-way site or location for a national infrastructure project.
To determine the appropriate price offer, the implementing agency may engage the services of a government financial institution or an independent property appraiser.
The property owner is given thirty (30) days to decide whether or not to accept the offer as payment for his property.

WHAT ARE THE MODES OF ACQUIRING REAL PROPERTY UNDER REPUBLIC ACT NO. 10752 OTHERWISE KNOWN AS “THE RIGHT-OF-WAY ACT”

Private property shall not be taken for public use without just compensation
The government may acquire real property needed as right-of way site or location for national government infrastructure project
A national government project involves underground works within a depth of fifty (50) meters from the surface

Every registered and licensed real estate service practitioner shall establish and maintain a principal place of business
Every registered and licensed real estate service practitioner shall conspicuously display the original and/or certified true copies of certificate of registration in his or her office
