Commerce plays a huge part of our lives, whether we buy food, stock up on toiletries, and have a haircut. In these, we make choices on what to avail and what to avoid. Identity of goods or services is therefore crucial as we look for the brand or trademark that we habitually, if not loyally, patronize.
Trademarks or marks identify the origin of goods or services offered in the market. They are not limited to words and may come through letters, numbers, symbols, or any combination conceivable by imagination. Since consumers are influenced by brands, acquiring exclusive rights over marks becomes necessary.
To avail of trademark protections under the law, one must have its trademark registered first with the IPO. The registered owner shall then have exclusive right to prevent others from using identical or similar marks for goods or services where it would result in likelihood of confusion. If identical signs are used for identical goods or services, the law presumes likelihood of confusion.
Unregistered marks are at risk of being imitated without protection. Worse, someone else who registers a mark may even label its true owner as an “infringer”. Non-registration of marks actually puts into risk not only the marks themselves, but even the products and services that they represent. Ultimately, the businesses with unregistered marks are the ones that may suffer the consequences of failing to afford protection on that very name or symbol identifying the enterprise, or its products or services.
In the seminar, “Give Your Business Its Own Identity: The Essentials of Trademark for SMEs”, the participants will learn the trademark registration process and its various stages, as well as the steps that every trademark applicant needs to take. Knowing how to register and acquire exclusive rights over one’s trademark will help confer a unique identity upon the enterprise, its products and/or services, which shall serve as the cornerstone in building the reputation and goodwill of the business.
