The second (2nd) day of February of every year is declared as Constitution Day.
Proclamation No. 211, series of 1988, declared February 02 of every year as the Philippine Constitution Day to instill in the hearts and minds of the Filipino people the democratic principles and the noble and lofty ideals enshrined in the Constitution. The proclamation intends to give the Filipino people the opportunity to consecrate and dedicate themselves to the Constitution and ponder on its significance.
The law says:
“NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in my by law, do hereby declare the 2nd day of February of every year as CONSTITUTION DAY.”
Under Proclamation No. 211, s. of 1988, the 1987 Constitution is the fundamental law of the land.
The law says:
“WHEREAS, this Constitution, as the fundamental law of the land, envisions a just and humane society and a government that embodies the ideals an aspiration of the Filipino people, promotes the common good, and secures to themselves and their posterity, the blessings of independence and democracy under the rule law and a regime of truth, justice, freedom, love, equality, and peace.”
A constitution is a system of fundamental laws for the governance and administration of a nation It is supreme, imperious, absolute and unalterable except by the authority from which it emanates. It has been defined as the fundamental and paramount law of the nation. It prescribes the permanent framework of a system of government, assigns to the different departments their respective powers and duties, and establishes certain fixed principles on which government is founded. (Manila Prince Hotel v. GSIS, G.R. No. 122156, February 03, 1997).
What is the Doctrine of Constitutional Supremacy?
In the case of Manila Prince Hotel v. GSIS (G.R. No. 122156, February 03, 1997), the Supreme Court held:
“Under the doctrine of constitutional supremacy, if a law or contract violates any norm of the constitution that law or contract whether promulgated by the legislative or by the executive branch or entered into by private persons for private purposes is null and void and without any force and effect. Thus, since the Constitution is the fundamental, paramount and supreme law of the nation, it is deemed written in every statute and contract.”
