The Bureau of Customs (BOC) issued Memorandum No. 42-2024, which instructed all district and sub-port collectors, and all others concerned, to strictly enforce measures to stop or prevent all attempts to smuggle and illegally import unregistered and uncertified Vaporized Nicotine and Non-Nicotine Products, through misdeclaration and other fraudulent schemes.


 

The Bureau of Customs (BOC) issued Memorandum No. 42-2024 dated August 22, 2024, governing Vaporized Nicotine and Non-Nicotine Products. Under the relevant law, Republic Act (RA) No. 11900 or the “Vaporized Nicotine and Non-Nicotine Products Regulation Act”, “Vaporized Nicotine or Non-Nicotine Products” refer to both “Heated Tobacco Products” (HTP) and “Vapor Products”, which are novel consumer goods that generate an aerosol without combustion, and may or may not contain nicotine.

 

BOC’s Memorandum No. 42-2024 specifically instructs all district and sub-port collectors, and all others concerned, to strictly enforce measures to stop or prevent all attempts to smuggle and illegally import unregistered and uncertified Vaporized Nicotine and Non-Nicotine Products, through misdeclaration and other fraudulent schemes. 

 

The Memorandum likewise warns that any Bureau official and personnel found conspiring with importers illegally smuggling said products will be dealt with under the law.
